Parents whose children obtain a driver’s license should be aware of the laws regarding driving under the influence of alcohol or a controlled substance. For adults, the alcohol concentration in an individual’s blood or breath becomes illegal at .08% in Pennsylvania. However, for an individual under 21 years of age, illegal concentration of alcohol in a minor’s blood or breath is .02%. Consequently, it is much easier for a minor to be found in violation of that statute.
In addition, any amount of a controlled substance, which include many medications, is illegal at any concentration. Violation of the DUI laws by minors can have lasting effects (potentially, even into adulthood), so parents should be aware and pay attention to their children’s driving habits. Unfortunately, we have seen an increase in the amount of opioid-based medications being taken illegally by minors. In addition to potentially leading to more dangerous drug consumption, the illegal taking of prescription drugs by minors can adversely affect their ability to drive, and thus hold jobs.
All parents should be very mindful of this problem and take the necessary steps to protect prescription medication so that it does not come into the hands of their children or their friends. In this regard, you should be aware that the DA’s office sponsors a medication drop-off program wherein many municipalities provide drop-boxes for the safe disposal of excess medications.
