This Week at Weber Kracht and Chellew | 11.8.14

November 7, 2014 By WKCLawBlog

Weekly Wrap-up image

We hope you’ve had a terrific week. Grab a mug of your favorite morning pick-me-up and catch up with all things Weber Kracht and Chellew.

First, we wanted to say yet again how incredibly proud we are of our firm administrator, Karen Chellew, for running a strong campaign to become the Pennsylvania state representative of the 145th district. Although the results were not in her favor, Karen and her team inspired many to focus on #communitynotpolitics.

A new series was launched within our blog, The Weber Kracht and Chellew Difference. Throughout this series, our attorneys will share firsthand experiences with our clients. This week, Abigail Fillman shares how going the extra mile with a client made all the difference in the client’s life.

#TBT (Throwback Thursday) took us back to Race Judicata. Held earlier this year. Race Judicata is organized by the the Bucks County Bar Association and raised funds for Legal Aid of Southeastern PA, an organization that provides free legal aid to local low-income and vulnerable residents.

Save the date for our  Child ID event on Saturday, November 29. We’re teaming up with the Quakertown Rotary Habitat 5K & Kids’ Fun Run. The Child ID is FREE of charge for all children participating in the Kids’ Fun Run. The Bucks County Sheriff”s Department will be administering the IDs inside the Quakertown United Methodist Church from 8am-12Noon. Learn more about the 5K and Kids’ Fun Run here and also here.

Keep up with all Weber, Kracht and Chellew news by checking this blog, liking us on Facebook, connecting with us on LinkedIn or following us on Twitter.

Meet the Attorneys: Mike Frisbie

October 21, 2014 By WKCLawBlog

MikeFrisbie

Mike Frisbie provides individuals and businesses with top level legal services for their everyday situations and problems. Together, they plan and prepare solutions with a litigator’s eye towards avoiding litigation.  He takes pride and pleasure in helping people and businesses solve their problems.

Since graduating from law school in 1996, Mike has handled a wide array of litigation matters including personal injury, products liability, trucking and motor vehicle litigation, slip and fall, professional negligence, slander and civil rights matters on behalf of a range of individuals and businesses. Comfortable and knowledgeable in the courtroom fighting for his clients’ causes, Mike has substantial experience litigating cases in Pennsylvania State Courts and the Federal Courts. Clients appreciate how Mike is better prepared than his opponents and knows the facts and law “cold” so that he is the best advocate for them.

In addition to his trial practice, Mike is a valuable resource for small businesses who seek his help to employ successful operational and growth strategies with an eye toward avoiding costly litigation and conflict.  A large part of Mike’s practice is also dedicated to estate planning and estate administration. The grandson of dairy farmers, Mike is committed to helping small businesses and individuals understand the full array of legal steps they can employ to prosper and protect their businesses and families for generations to come.  Mike provides reasoned and practical advice to his clients in a manner that is easy to understand.

Mike takes pride in his client loyalty in that it shows satisfaction with a job well done.  For example, Mike successfully represented a large corporation in Northeast Pennsylvania providing litigation and other general counsel business advice.  Mike developed a good relationship with the principals of the business such that new files were referred directly to Mike for handling and counsel.  Mike’s aggressive, but practical, advice led to many cases being dismissed, smart settlements, and, where appropriate, great trial results.

Mike is dedicated to his profession and to his community.  Mike is a member of the Bucks County Bar Association, as well as that of his native Poconos’ community, the Monroe and Pike County Bar Associations.  He serves as a Court-appointed arbitrator on Arbitration Panels in the Courts of Common Pleas of Bucks, Lehigh and Monroe Counties and has also been selected by his peers for private arbitration matters.  In 2004, he completed the prestigious National Institute of Trial Advocacy Program at Temple University to hone his trial skills. He has lectured on arbitration practice in Philadelphia County and to numerous industry professionals on the topics of Pennsylvania law, Pennsylvania practice, and litigation strategies in Pennsylvania.

While in law school, Mike worked at the Rutgers Environmental Law Clinic, participated in an Internship at the United States Environmental Protection Agency and provided advice to small businesses through the Rutgers Small Business Counseling Clinic.  He was a  member of the Hunter Advanced Moot Court Program and provided community assistance with tax preparation with the Volunteer Income Tax Assistance Program.

When he’s not practicing law, Mike, an Eagle Scout, volunteers for  the Boy Scouts of America. He currently serves as a Vice President of the Executive Board of the Bucks County Council of the Boy Scouts of America  where he leads the Nominating Committee of the Council.  He is also a volunteer leader in Cub Scouts and Boy Scouts.  He has served as a Committee Chair and Den Leader with Cub Scout Pack 71 in Doylestown and volunteers for Troop 6 in Doylestown where his son is a Boy Scout.  Mike attributes his “uber-preparedness” to the Boy Scout Motto, “Be Prepared,” and his extremely caring and giving nature to his clients and community to living the Boy Scout Slogan  “Do a Good Turn Daily.”

Mike also coaches his children’s soccer teams at Warrington Soccer and basketball teams at the Doylestown Athletic Association.  He is a past volunteer with Habitat for Humanity of Greater Bucks.

He was a Dean’s List student in college and law school, and valedictorian of his high school class.  He received the American Jurisprudence Award for Civil Procedure in his first year of law school at Widener University School of Law.  Mike received his law degree from Rutgers University School of Law in Camden  in 1996. He received his Bachelors of Arts in History from The Pennsylvania State University in 1990 becoming the seventh member of his family to graduate from the school.  He, his father, brother, sister-in-law, and nephew have all played instruments in the Penn State Marching Blue Band (He played the sousaphone.).

Meet the Attorneys: Michael Kracht

October 14, 2014 By WKCLawBlog

MichaelKracht

Michael Kracht became a lawyer quite simply to help people and make a meaningful difference in their lives. It is that desire to help and go way beyond the typical “call of duty” that motivates him to be an outstanding advocate and counselor to his clients. Those who know him say he brings an unparalleled level of commitment to his clients – becoming personally invested in their problems and goals – which may be the reason his work has overwhelmingly come from past clients and other members of the Bar during the last 35+ years. As Managing Shareholder of the firm, Michael leads by example, instilling in his staff and lawyers his profound belief that it is everyone’s responsibility to help those in the community to the best of everyone’s abilities.

Michael’s practice focuses on real estate, land development, municipal law and litigation matters. His clients have been and continue to be varied. He currently acts as Solicitor to Dublin Borough and the Silverdale Zoning Hearing Board. In the past, he has served as Solicitor to Perkasie and special counsel to both Sellersville and Souderton. Additionally, he currently represents several local charities and service organizations such as Pennridge Fish, The American Foundation for Children with AIDS, the Perkasie Fire Department and Sellersville Fire Department, predominantly in Upper Bucks and Montgomery Counties. Projects have included the development of commercial and residential properties, the adaptive re-use of dilapidated properties, the dedication of a substantial amount of open space, the successful opposition to the development of open space, and litigation of real estate disputes and personal injury claims. He has taken special pride in his work to help properties maintain their historical value and protect the environment. Of special importance to Michael is his work as a founding Board member and attorney for over 20 years to the Keystone Opportunity Center, a recognized regional leader in community supported social services. Twenty properties managed by Keystone provide affordable housing and eligible individuals from the entire Pennridge and Souderton areas receive food, and clothing assistance from this organization.

A graduate of Northwest Missouri State University, Michael received his law degree from Washburn University in 1979. He is admitted to the Pennsylvania Bar as well as the United States District Court for the Eastern District of Pennsylvania, the United States Court of Appeals for the Third Circuit and the United States Supreme Court.

Michael’s desire to give back started decades ago. After graduating from law school, Michael served as an Assistant Attorney General in the State of Kansas. Thereafter, he entered the Peace Corps, teaching children in Ecuador for several years before returning to the States and joining the staff of Chester County’s Legal Aid Office. Despite his busy practice, to this day Michael is active in doing pro bono work for the community including handling protection from abuse matters.

What Do All These Motor Vehicle Insurance Terms Mean?

October 13, 2014 By WKCLawBlog

Insurance_Risk_highwaysigns

Anyone who owns a motor vehicle in Pennsylvania is required to maintain insurance on that vehicle. This introduces you to an entire set of terms, most of which you’ve likely had little to no experience with. The purpose of this blog post is to give you some help in understanding those terms.

The motor vehicle statute has a large number of words and phrases that are capable of causing confusion. Here are, in my opinion, some of the more important ones to understand:

  • Required Benefits
All motor vehicle policies must provide a medical benefit of at least $5,000.00. You may purchase more medical coverage if you like, but you also should understand how your own health insurance coverage may already cover medical bills in excess of that amount. One of the main differences between this health coverage benefit is there are no deductibles or co-pays as are found in many health insurance policies.
  • Minimum Policy
This is what is known as Liability Coverage. In Pennsylvania, we must all carry a policy with liability coverage in the minimum amount of $15,000.00 because of injury to one person in any one accident, and in the amount of $30,000.00 because of injury to two or more persons in any one accident. You consult with your insurance professional to discuss whether you need to consider coverages in additional amounts based upon your economic circumstances. You are also required to carry a minimum amount of coverage for damage to the property of others in the amount of $5,000.00
  • Availability of Benefits
In addition to the required medical benefit described above each insurer must also make available other benefits, though you are not required to purchase those. They are as follows:
  1. Income Loss Benefits
This covers lost income. Before purchasing this or any other optional benefit, you should understand what coverages you already have. For instance, some employers provide some form of this benefit.
  2. Death Benefit
This option operates pretty much the same as a life insurance policy.
  3. Funeral Benefit
This optional benefit pays the expenses directly related to the funeral and burial/cremation incurred as a result of death.
  4. Extraordinary Medical Benefits
This is additional coverage for medical bills which exceed $100,000.00.

This is just a start, but hopefully it answers some questions you may have about motor vehicle insurance lingo. If you have more questions, please contact our office. We’d be glad to help you.
