MLK Day On

Today as a nation we pause to remember Dr. Martin Luther King, Jr. and his life of service.

Service – to each other, our clients and our community – is at the forefront of our mission here at Weber Kracht & Chellew. Over the holidays we collected items for Manna on Main Street, a food pantry and soup kitchen in Lansdale, PA that also provides emergency financial aid, counseling and referrals, and educational opportunities to those in need.

We created teams among our staff to collect as many items as possible on Manna’s wish list: diapers, feminine care products, toiletries & hygiene products,canned food, boxed food (cereal/pasta), and cleaning products. The generosity and energy of our staff resulted in a donation of 71 lbs of items and this sweet thank you note.

These are the words and ideas that come to mind when we start thinking about our December word of the month: Promise. A promise can be a one time commitment. It can also be an ideal to strive for – a goal.

The word takes on special meaning as we celebrate this holiday season and look ahead to the New Year.

With promise comes the excitement that good things lie ahead. We hope and wish the same for you and your loved ones this special time of year.

What is a Living Will or Advance Directive and How Does it Relate to a Health Care Power of Attorney?

When people refer to a Living Will or an Advance Directive in Pennsylvania, they are referring to the same thing. In Pennsylvania, adults — with a few exceptions — have a right to decide whether to reject, accept, limit or discontinue medical care/treatment.  You have the right to make your own health care decisions as long as you have the capacity to do so.  If someday you are unable to make those decisions, then the Living Will is your written expression of your intentions about the medical care you would like to receive.  The Living Will allows you to retain control over your life — whether it should be controlled by the use of artificial means in the event you are incompetent, in a terminal condition or are permanently unconscious.

This Living Will law permits you to name someone as your surrogate to make those same decisions. However, your chosen surrogate may only make the decisions regarding your care governed specifically by the Living Will, not all health care related decisions.  The law in Pennsylvania also permits you to make decisions about treatment such as cardiac resuscitation, mechanical respiration, feeding tubes, blood products, surgery, dialysis, and antibiotics.  Some religious faiths distribute their own preferred forms.

When I speak with clients about Living Wills, I often speak with them about preparing a Health Care Power of Attorney as well.  A  Health Care Power of Attorney (Healthcare POA) is also a written document where you authorize someone (your Agent) to make health care decisions for you in the event you are cannot make those decisions yourself.   The Healthcare POA has broader application than the end of life circumstances of a Living Will.  You grant your Agent the power to act as your Agent in all health care related decisions in the event you cannot.

One of the biggest advantages of a Healthcare POA is that it permits a health care provider to speak with your Agent.  Many clients tell me that the reason for their wanting a Healthcare POA stems from personal experiences where doctors were not permitted to speak with them about their parents’ health due to the privacy concerns controlled by HIPAA (The Health Insurance Portability and Accountability Act of 1996).  A Healthcare POA can overcome this possibility.

These documents need to be prepared and executed prior to the time you might need them.  The preparation and signing of both documents, along with a Will and a General Power of Attorney, are a good foundation for your Estate Planning.  I am happy to discuss these with you. As with many routines, the Word of the Month took a break over the summer. Here we are in September, back in the swing of things. Returning to a regular schedule coupled with the shift of seasons also provides a format for realigning our focus. So it makes sense that September’s “Word” of the Month is an acronym: H.O.D.S. Developed by an author unknown to us and standing for Honest – Open – Direct – Specific, it’s the basis for our communication amongst each other here in the office as well as with our clients.

Not only because it’s a key component of our mission but also because we know the outcomes of these cases affect people’s lives.  It is especially heartening – and humbling – when we receive thanks from a member of our military.

Thank you very much for your assistance in this matter, being stationed overseas for a period of time has an effect of amplifying stressors (such as a lawsuit from an unrelated incident over 2 years ago), especially on young Marines who haven’t seen their families in over a year. The initiative and professionalism displayed by your office directly resulted in a calm mindset in my head, knowing that the matter was being addressed in the background by professionals like yourselves, and there is nothing more I could have asked of you.
