Happy St. Patrick’s Day from Weber, Kracht & Chellew

They say everyone is Irish on St. Patrick’s Day, so no matter how – or whether – you’re celebrating we wish you the luck of the Irish today and every day.

St. Patrick’s Day does have significant meaning to our own Rick Howard. Did you know that he’s a Civil War history buff? When he’s not practicing law, one of his favorite pastimes is his participation in The 69th PA Irish Volunteers, a Civil War reenactment group.

Their website explains the history of these soldiers and the mission of the group today:

During the American Civil War, the lads of The 69th PA Irish Volunteers fought in every campaign with the Army of The Potomac. From 1861 to 1865 they were in the midst of almost every major battle. These men, mostly born in Ireland, fought under their green battle flag to save the Union. Today, we reenactors honor their memory by participating in living history programs, parades, gravesite ceremonies, history trips, music programs and battle recreations.

The 69th PA Irish Volunteers most recently participated in Philadelphia’s St. Patrick’s Day Parade on Sunday, March 12.

MLK Day On

Today as a nation we pause to remember Dr. Martin Luther King, Jr. and his life of service.

Service – to each other, our clients and our community – is at the forefront of our mission here at Weber Kracht & Chellew. Over the holidays we collected items for Manna on Main Street, a food pantry and soup kitchen in Lansdale, PA that also provides emergency financial aid, counseling and referrals, and educational opportunities to those in need.

We created teams among our staff to collect as many items as possible on Manna’s wish list: diapers, feminine care products, toiletries & hygiene products,canned food, boxed food (cereal/pasta), and cleaning products. The generosity and energy of our staff resulted in a donation of 71 lbs of items and this sweet thank you note.

What is a Living Will or Advance Directive and How Does it Relate to a Health Care Power of Attorney?

When people refer to a Living Will or an Advance Directive in Pennsylvania, they are referring to the same thing. In Pennsylvania, adults — with a few exceptions — have a right to decide whether to reject, accept, limit or discontinue medical care/treatment.  You have the right to make your own health care decisions as long as you have the capacity to do so.  If someday you are unable to make those decisions, then the Living Will is your written expression of your intentions about the medical care you would like to receive.  The Living Will allows you to retain control over your life — whether it should be controlled by the use of artificial means in the event you are incompetent, in a terminal condition or are permanently unconscious.

This Living Will law permits you to name someone as your surrogate to make those same decisions. However, your chosen surrogate may only make the decisions regarding your care governed specifically by the Living Will, not all health care related decisions.  The law in Pennsylvania also permits you to make decisions about treatment such as cardiac resuscitation, mechanical respiration, feeding tubes, blood products, surgery, dialysis, and antibiotics.  Some religious faiths distribute their own preferred forms.

When I speak with clients about Living Wills, I often speak with them about preparing a Health Care Power of Attorney as well.  A  Health Care Power of Attorney (Healthcare POA) is also a written document where you authorize someone (your Agent) to make health care decisions for you in the event you are cannot make those decisions yourself.   The Healthcare POA has broader application than the end of life circumstances of a Living Will.  You grant your Agent the power to act as your Agent in all health care related decisions in the event you cannot.

One of the biggest advantages of a Healthcare POA is that it permits a health care provider to speak with your Agent.  Many clients tell me that the reason for their wanting a Healthcare POA stems from personal experiences where doctors were not permitted to speak with them about their parents’ health due to the privacy concerns controlled by HIPAA (The Health Insurance Portability and Accountability Act of 1996).  A Healthcare POA can overcome this possibility.

These documents need to be prepared and executed prior to the time you might need them.  The preparation and signing of both documents, along with a Will and a General Power of Attorney, are a good foundation for your Estate Planning.  I am happy to discuss these with you. Winter Clothing Drive for Pennridge FISH

Even though it’s been a beautifully mild fall, we know that chillier days are just around the corner. With that, we are kicking off a Winter Clothing Drive to benefit our local social service agency, Pennridge FISH.

From November 6-23, we are asking area businesses to consider placing a collection bin in their offices where members of our community can bring donations for our fellow friends and neighbors in need. You may also bring your donations to our office at 847 West Market Street, Perkasie, PA.

Items we are collecting (new or gently used):

Do I Really Need a Real Estate Attorney?

Many people wonder if it’s necessary to incur the additional expense for an attorney for the purchase of real estate.  The simple answer is, in many cases, your interests can be appropriately handled by a competent realtor.

Additionally, in Pennsylvania, most realtors use “form” real estate contracts that are not weighted either pro-seller or pro-buyer.  After the agreement is signed, an experienced realtor should also be able to address and negotiate the usual things that come up, such as the results of a home inspection.

Having said that, in a significant number of instances it is advisable to seek the advice of an attorney before entering into what will likely be one of the largest financial commitments of your life.  As well, it is good to remember that lawyers, like most professionals, have increasingly specialized capabilities. So, you should seek out the advice of an attorney who has experience in this area of law. Sadly, many attorneys are not willing to give up this information unless specifically asked. Also, don’t rely on website information since advertising to practice in an area of law gives you no real information as to an attorney’s depth of experience. An inexperienced attorney can further botch something up due their lack of experience.

There are however, several kinds of real estate transactions that warrant the help of a competent attorney in order to ensure your interests are being protected. Some examples would be:

For a Buyer

  • Is this an investment property?
  • Is this a commercial property?
  • Is this property part of a subdivision or Homeowner’s Association?
  • Are there any known environmental concerns with the property (i.e., flood zone, buried fuel tanks)?
  • Are there any easements that could restrict the use of the propert?
  • Is the property for sale by Owner?

You might also check with the local municipal office as most keep a “property specific” file which could include information regarding zoning and structural issues.

For a Seller

  • Do you own the property by yourself  or in some kind of entity?
  • Are you aware of problems with the property that will require delicate handling?
  • Are there any judgments or liens against the property?
  • Do you intend to invest the proceeds of this sale in another property?

If you answered “yes” to any of these questions or just feel in your gut that you should check with an attorney, it is best to do so. Most lawyers charge a reasonable amount for an initial consultation where you can ask your questions and get an estimate for some on-going help. Also, best to do this before signing an Agreement of Sale as some of these issues must be handled before an Agreement is signed.
